PerliDial Terms of Use

These terms apply to the PerliDial app for Android, published by Perlicom Systems Limited, a company registered in Ireland under company number 546999 ("we", "us"). By installing or using PerliDial you agree to them. How data is handled is explained in the PerliDial Privacy Policy — in short, it stays on your phone.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use PerliDial on devices you own or control, in line with these terms and, where you installed it from Google Play, the Google Play Terms of Service. You may not copy, sell, rent or redistribute the app, or reverse engineer, decompile or modify it, except where the law allows this regardless of these terms. We and our licensors keep all rights not expressly granted to you.
2. What the app is
PerliDial is a replacement dialler. With your permission Android makes it your default phone app, and it then provides the keypad, the contacts and recents lists, the incoming-call screen, the in-call screen and call blocking. You can change your default phone app back at any time in Android's settings, and PerliDial keeps working as an ordinary app until you do.
We are not a telephone company. PerliDial does not carry your calls: your mobile network does. We provide no call service, no number and no coverage, and calls are billed by your network operator under your agreement with them.
3. Emergency calls — read this one
Emergency calls are handled by Android and by your mobile network. PerliDial does not screen, block, delay or filter an emergency call. It cannot make a call where your phone has no network, no SIM or no power, and no app can. Do not rely on any single device or app as your only means of reaching the emergency services, and if you have any doubt that your phone will place an emergency call, set your default phone app back to the one your phone shipped with.
4. Blocking, screening and caller information
Call blocking works through Android's call-screening framework and depends on your phone, your Android version and your network. A blocked number may still reach you — through a different number, through another app, or where the network delivers the call in a way the framework cannot intercept. Caller names, number labels and any "this looks like a nuisance call" hint are worked out on the phone from your own contacts and call history and from a numbering-plan table; they are an aid, not a fact. They can be wrong, and a number can be spoofed. Decide for yourself whether to answer, and never rely on what the app shows to judge a caller's identity.
5. Contacts, cards and beaming
Editing a contact in PerliDial changes the phone's own address book, which your other apps share. Beaming a contact card by sound or over Bluetooth sends it to whatever is listening nearby: treat it like speaking the details aloud, and do not beam someone else's details without their agreement. Where the details you hold and send are another person's personal data, you are responsible for handling them lawfully.
6. Use it lawfully
You must not use PerliDial to harass anyone, to make unlawful, nuisance or automated calls, to impersonate anyone, to record a call where you may not, or in any way that breaks the law where you are. You are responsible for the calls you make and for what you do with contact details you obtain through the app.
7. Free version and advertising
PerliDial shows no advertising today. If it ever does, the placement rules in section 6 of the Privacy Policy apply: never on or over a call, never on the keypad, no full-screen ads at all, and nothing from your phone shared with an advertiser.
8. Updates and availability
Copies installed from Google Play are updated by Google Play. PerliDial deliberately never puts a forced update screen between you and the keypad or between you and Hang up. We may change, add or remove features to fix problems, improve the app or meet legal and store requirements, and behaviour differs between manufacturers, Android versions and networks — we cannot guarantee any particular telephony feature on any particular phone.
9. Liability
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, and to the fullest extent the law allows: the app is provided "as is"; we exclude implied warranties; and we are not liable for lost profits, lost data, lost or deleted contacts or call-log entries, or indirect or consequential loss, including any loss arising from a call that was blocked, missed, not connected or wrongly identified. Our total liability to you in any twelve-month period is limited to the amount you paid us for PerliDial in that period, or €100 where you paid nothing.
10. Ending these terms
You may stop using PerliDial at any time by setting another default phone app and uninstalling it. We may end your licence if you materially breach these terms. Sections 3, 6, 9 and 11 survive the end of these terms.
11. Governing law
These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, except that if you are a consumer you keep the protection of the mandatory laws of the country you live in and may bring proceedings there.
12. Third-party names
Android and Google Play are trademarks of Google LLC. WhatsApp, Telegram, Signal, Messenger, Instagram and other app names shown in the hand-off sheet belong to their owners and are used only to say which app a number would be passed to. PerliDial is not affiliated with or endorsed by any of them.
13. Changes to these terms
We may update these terms as the app or the law changes, and will change the effective date above. Continuing to use PerliDial after a change means you accept the updated terms.
